Story of Justice: Margaret Battles Unsafe Living Conditions

Safe, stable housing is essential to healthy aging. For seniors, like Margaret, it provides security, independence, and peace of mind. Coast to Coast Legal Aid of South Florida (CCLA) works to protect housing rights so older adults can age with dignity and safety.

Mold can be a tenant’s worst nightmare, especially for a disabled senior. For Margaret, mold spread quickly throughout her apartment, growing on clothes, shoes, and almost every belonging she had. Living in those conditions became unbearable. She knew she had to leave her home, even if it meant leaving a lot of her personal belongings behind.

Believing she should not have to pay rent under such unsafe conditions, Margaret withheld her rent hoping the landlord would remediate the mold. Instead, her landlord filed an eviction case for non-payment of rent. For Margaret, the stakes were high. An eviction on her record could jeopardize her Section 8 housing voucher, the very resource that allowed her to afford stable housing.

Although Margaret did her best to file an answer in court on her own, she did not raise multiple legal defenses that may have been available to her. Without legal counsel, she simply did not know how to navigate the complex court process. She came to CCLA frustrated, overwhelmed, and deeply worried about losing both her home and her housing assistance.

How Was the Issue Resolved?

With a hearing date approaching, our CCLA attorney saw an opportunity! The corporate landlord had not yet retained legal counsel, as required by statute. By highlighting this issue, and stressing the costs of litigation, the CCLA attorney created leverage to push for settlement.

Both parties wanted to move forward: Margaret needed safe housing and the landlord wanted to re-rent the apartment without the ongoing dispute. After strategic negotiations, the CCLA attorney secured a favorable settlement: the landlord agreed to waive all back rent in exchange for Margaret vacating within two weeks. The landlord also agreed to dismiss the eviction case against Margaret. To protect her interests, the CCLA attorney appeared in court to file the settlement, preventing any eviction judgment from being entered against Margaret.

How Did the Outcome Benefit CCLA’s Client?

The resolution gave Margaret immediate relief. Instead of scrambling to pay rent for an uninhabitable unit, she was able to use her limited funds to cover moving costs and salvage what of her belongings she could. Most importantly, preventing the eviction preserved her Section 8 housing voucher, keeping her in good standing for future housing.

What began with the threat of eviction and homelessness, ended with Margaret leaving the mold-infested apartment on her own terms, avoiding both financial harm and the loss of her housing benefits. Thanks to CCLA’s intervention, this disabled senior not only escaped unsafe living conditions, but also maintained her path to safe, affordable housing.
